RSF Calls on the European Union to Sanction Delhi Police Officers

RSF and Guernica 37 are calling for European Union sanctions against these police officers, under a scheme introduced in December 2020 to address serious human rights violations in third countries.

International press freedom organization Reporters Without Borders (RSF) and Guernica 37 Chambers call on the European Union to sanction four high-ranking officers of the Delhi Police, responsible – directly or indirectly – for exactions against dozens of journalists working or having collaborated with the independent media NewsClick.

According to RSF, the arbitrary raid by the Indian police against journalists working for the independent online media NewsClick must not go unaddressed. RSF and lawyers from Guernica 37 Chambers, which specializes in human rights and international criminal law, submitted the case to the European External Action Service (the European Union’s diplomatic service) with a request to refer it to Member States to adopt sanctions against four officials of the Delhi Police’s counter-terrorism unit, who are involved in an unprecedented crackdown on journalists in the country.

On their orders, according to RSF, members of this Special Cell raided the homes of 46 journalists in the capital (New Delhi) and surrounding towns in October 2023. 

All were journalists, contributors or former employees of NewsClick, an independent media founded in 2009. More than 480 electronic devices – including telephones and laptops – were seized. 

Two members of the media company – Human Resources Director Amit Chakravarty and NewsClick founder Prabir Purkayastha – were taken into custody and charged under the draconian UAPA (Unlawful Activities Prevention Act) anti-terrorism law. They have since been detained in Delhi’s Tihar prison.

RSF and Guernica 37 are calling for European Union sanctions against these police officers, under a scheme introduced in December 2020 to address serious human rights violations in third countries. These can range from a ban on entering the European Union to the freezing of assets on that territory and the prohibition of doing business with European entities.

“The actions of the Delhi Police Special Cell against journalists associated with NewsClick represent one of the most blatant attacks on press freedom in India. These raids, carried out on an unprecedented scale, with the deployment of 500 police officers, are an alarming step in an already worrying context of repression of journalists. These acts of terror require urgent action on the part of the European Union. This would be a strong act to alert the international community on the unacceptable repression of journalists, and a necessary warning to the Indian authorities in the run-up to the general elections,” said Célia Mercier, RSF’s South Asia Desk in a statement issued on March 27.

Accused by this specialized police unit of receiving illegal Chinese funding, the NewsClick editorial team is mainly targeted for its investigative reporting. 

The RSF statement adds that several journalists targeted by the raids had investigated alleged fraud committed by the Adani conglomerate, whose chairman is considered close to current Prime Minister (PM) Narendra Modi. 

Other reporters appear to have been targeted for their coverage of farmers’ protests between 2020 and 2021. The Delhi Police Special Cell, according to RSF, under the direct control of the Home Ministry headed by Amit Shah, is regularly used to intimidate voices critical of the government – this was notably the case during the student protests of 2020 with several arrests of activists protesting against the controversial Citizenship Amendment Act (CAA) reform.

“The Delhi Police’s Special Cell seems to be one of the go-to bodies for the government of India to target critics, including journalists. Their speciality lies in the use of the UAPA to target dissidents. Both the UN and multiple foreign governments have warned the UAPA is ripe for misuse by authorities,” said Toby Cadman, Barrister and Founder of Guernica 37 Chambers.

According to RSF, press freedom has been under constant attack in India since Narendra Modi came to power. In 2023, India fell a further 11 places in RSF’s World Press Freedom Index to its worst ever position of 161st/180th, down from 133rd in 2016.

UN Experts Demand Release of Human Rights Lawyer Arnon Nampa in Thailand

Arnon Nampa is also facing ongoing disbarment proceedings before the Lawyers Council of Thailand.

A group of UN experts* today (March 25) expressed alarm over the use of Thailand’s lèse-majesté laws to convict and sentence human rights defender and lawyer, Arnon Nampa.

Arnon Nampa is a founding member of Thai Lawyers for Human Rights (TLHR). He has provided free legal assistance, including representation in litigation, to individuals in vulnerable situations, and on highly sensitive cases.

On 26 September 2023, Arnon Nampa was convicted and sentenced to four years in prison under Article 112 of the Thai Criminal Code. He has been in detention since and on 17 January 2024, he was sentenced to a further four years. 

According to the UN Human Rights Office, these charges are related to a speech he delivered at a peaceful pro-democracy demonstration calling for reform of the monarchy. 

Nampa also questioned the enforcement of Section 112 of the Thai criminal code – which seeks to curtail criticism of the monarch of Thailand – and its impact on freedom of expression in the country.

“The prison sentences and repeated criminalisation of Mr. Nampa’s work are completely disproportionate and form part of a concerning trend of deliberately silencing human rights defenders and other dissenting voices,” the experts said. “The use of lèse-majesté charges in Thailand has been a cause of alarm for years, and Special Procedures mandate holders have sent several communications to the Government of Thailand expressing concerns in this regard.”

“Harsh sentences for those defending human rights and exercising their rights to freedom of expression and peaceful assembly are incompatible with Thailand’s international legal obligations. They have a chilling effect on human rights defenders, civil society and fundamental rights and freedoms,” the experts said.

Arnon Nampa is also facing ongoing disbarment proceedings before the Lawyers Council of Thailand in relation to a speech he made on 3 August 2020, calling for reform of the monarchy.

“Criticism of the monarchy and speech proposing reforms and advocating for human rights should be protected and promoted in a democratic society. We call on the Thai authorities to overturn Mr. Nampa’s conviction and drop the remaining charges against him,” the UN experts said. “Lawyers have the right to freedom of expression and must not be deprived of their right to practice on the basis of ideas they have expressed in the exercise of the legal profession.”

“We reiterate our long-standing call on the authorities to repeal the lèse-majesté law, bring the Criminal Code into line with international human rights standards, drop charges against those who are currently facing criminal prosecution and release those who have been sentenced for the sole exercise of their rights to freedom of expression,” they said.

ABOUT THE PETITION

The Indian state of Punjab – where most people belong to the minority Sikh community – has been facing a situation of extreme unrest particularly for the past 2 years, beginning 2022. 

As the Punjab Government under chief minister (CM) Bhagwant Mann is not able to run the government affairs effectively, the government is misusing its authority and unleashing police brutality to terrorize innocent people who raise their voice against misgovernance in the state. 

Different sections of society including unemployed youth, farmers, journalists, and social activists are the targets of CM Bhagwant Mann’s oppression. 

Amritpal Singh, who is the leader of the ‘Waris Punjab De’ (or inheritors of Punjab) social group, was running various field campaigns to combat the dreaded drug menace in the state and asking people to follow the Sikh religion in order to protect them from the clutches of immorality prevalent in Punjab. 

Since it is reported that many local politicians in connivance with Punjab Police are clandestinely running the illegal drug racket in Punjab, CM Bhagwant Mann has not been quite eager to take action against the people of his own fraternity.

The Punjab and Haryana High Court has also observed that there is a criminal collusion between Punjab Police and criminals in the drugs mafia. According to an NDTV report of October 13, 2023, the court rebuked the Punjab Government and the police for allowing the drugs trade to flourish in Punjab. 

But the Bhagwant Mann government deliberately  ignored the court’s observation and drug addiction is spreading like a pandemic disease across the state of 30 million people. As a result of Bhagwant Mann’s inaction, thousands of people – young and old – are dying because of drug consumption. 

Since youth leader Amritpal Singh was spearheading a statewide campaign against lethal drugs so that the lives of people could be saved, the business of drug mafia – which colludes with police, politicians, and bureaucrats – was getting affected. 

Therefore, the Bhagwant Mann government – in connivance with the Central government of prime minister (PM) Narendra Modi – used draconian laws such as the National Security Act (NSA) to wrongfully incarcerate Amritpal Singh and his companions in the Dibrugarh jail of Assam which is thousands of miles away from their home state Punjab. 

As the hostile actions of the Punjab Government and the Central Indian government violate the human rights of Amritpal Singh and his companions, their rights should be protected through international intervention.

RESPONSE FROM PUNJAB STATE HUMAN RIGHTS COMMISSION

In response to this petition that I had filed in March 2024, I received a response from the Punjab State Human Rights Commission (PSHRC). In its order dated 02.04.2024, PSHRC asserted that since Amritpal Singh and his companions have already approached the competent authority of law (court) and the allegations are against the Government of India, PSHRC is not supposed to take any action in this case. make students employable in the contemporary job market. As a result, the joblessness is spreading like a pandemic disease and the students taught under this stale system cannot be called educated, as they never get ready for any work that can give them proper employment.

The proposed schools aim to overcome this problem by producing an employable workforce. The education will be based on a dynamic “Constructive Education Framework” that has been developed as an alternative education model. It connects education with employability and aims to produce morally sound and honest people with a view to build a clean and prosperous society. [ You can watch a related video. ]

The education model suggested to be used in the proposed modern schools can also be integrated with the state education policy to improve the education standards as well as the employment levels in different Indian states.

I urge the UN High Commissioner for Human Rights and other international authorities to intervene and help Indian farmers hold their peaceful protests in New Delhi under their direct supervision.

यदि आप अपनी हाउसिंग सोसाइटी में एफएआर निर्माण को रोकना चाहते हैं, तो आपको राफार (रेजिडेंट्स अगेंस्ट एफएआर) ग्रुप में शामिल होना चाहिए, जो दिल्ली के निवासियों का एक समूह है जो शहर में एफएआर निर्माण और धूल प्रदूषण को रोकना चाहते हैं।

फ्लोर एरिया रेशियो (एफएआर) निर्माण- जो दिल्ली की कोऑपरेटिव ग्रुप हाउसिंग सोसाइटीज (सीजीएचएस) में हो रहा है या जिसकी योजना बनाई जा रही है- एक हानिकारक गतिविधि है जो लोगों को स्वच्छ और शांतिपूर्ण वातावरण में रहने के उनके मौलिक अधिकार से वंचित करती है।

चूंकि एफएआर निर्माण जो वर्षों से चलता है, घातक धूल प्रदूषण, ध्वनि प्रदूषण, वायु प्रदूषण फैलाता है, और आवास परिसरों में गंभीर दुर्घटनाओं का कारण बनता है, हजारों बच्चे, पुरुष, महिलाएं – वरिष्ठ नागरिकों सहित – जो इन घरों में रहते हैं – पिछले कुछ वर्षों से पीड़ित हैं।

शहरव्यापी निर्माण-सह-भ्रष्टाचार रैकेट स्थानीय अपराधियों द्वारा चलाया जा रहा है जो हाउसिंग सोसाइटी के प्रबंधन समिति (एमसी) के सदस्यों के रूप में काम करते हैं। एमसी के सदस्य एफएआर निर्माण (FAR या floor area ratio construction) को अंजाम देने के लिए कुटिल राजनेताओं, भ्रष्ट नौकरशाहों, मिलीभगत पुलिस अधिकारियों, न्यायपालिका के बेईमान सदस्यों और बिल्डरों के माफिया के साथ मिलीभगत करते हैं। 

फर्जी वार्षिक आम बैठकों (एजीएम)/जनरल बॉडी मीटिंग्स (जीबीएम) में कपटपूर्ण निर्णय लेने के बाद, आपराधिक एमसी सदस्य बेईमानी से एफएआर परियोजनाओं के लिए निर्माण कंपनियों और वास्तुकारों को नियुक्त करते हैं। 

फिर वे निवासियों को एफएआर निर्माण के लिए भारी पैसा देने के लिए धमकाते हैं और मजबूर करते हैं, जबकि पीड़ित निवासियों के पास कोई मंच नहीं है जहां वे शिकायत कर सकें। 

हालांकि इस घोटाले में कई विभाग और अधिकारी शामिल हैं, लेकिन आपराधिक एमसी सदस्य मुख्य रूप से दिल्ली विकास प्राधिकरण (डीडीए), दिल्ली सरकार के रजिस्ट्रार सहकारी समिति (आरसीएस) कार्यालय, दिल्ली अग्निशमन सेवा (डीएफएस), दिल्ली शहरी कला आयोग (डीयूएसी), केंद्रीय प्रदूषण नियंत्रण बोर्ड (सीपीसीबी), दिल्ली प्रदूषण नियंत्रण समिति (डीपीसीसी), और दिल्ली पुलिस के भ्रष्ट अधिकारियों के साथ सांठगांठ करते हैं। 

यदि आप अपनी हाउसिंग सोसाइटी में एफएआर निर्माण को रोकना चाहते हैं, तो आपको राफार (RAFAR यानी रेजिडेंट्स अगेंस्ट एफएआर) ग्रुप में शामिल होना चाहिए, जो दिल्ली के निवासियों का एक समूह है जो शहर में एफएआर निर्माण और धूल प्रदूषण को रोकना चाहते हैं।

एक पत्रकार और पर्यावरण कार्यकर्ता के रूप में, मैं अकेले ही दिल्ली में एफएआर निर्माण और प्रदूषण को रोकने के लिए बड़े अभियान चला रहा हूं। आप भी इस प्रयास में मेरा साथ देने के लिए आमंत्रित हैं जिससे हम मिलकर दिल्ली के लाखों लोगों का जीवन बचा सकें। 

आप RAFAR समूह में शामिल हो सकते हैं और समूह की गतिविधियों के लिए सक्रिय रूप से काम भी कर सकते हैं। चूंकि निर्माण गतिविधि से प्रदूषण दिल्ली और उसके आसपास के सभी लोगों को नुकसान पहुंचाएगा, जो निवासी एफएआर निर्माण से सीधे प्रभावित नहीं हैं, वे भी एफएआर निर्माण और प्रदूषण को रोकने के अभियान का समर्थन करने के लिए राफार समूह के सदस्य बन सकते हैं। 

एक परिवार में परिवार के सभी सदस्य RAFAR समूह के सदस्य बन सकते हैं और इस पर्यावरण संरक्षण गतिविधि में भाग ले सकते हैं। आपसे यह भी अनुरोध है कि इस राफार समूह के लेख लिंक को ईमेल, व्हाट्सएप, फेसबुक, ट्विटर, लिंक्डइन या अन्य चैनलों के माध्यम से साझा करें ताकि अधिक से अधिक लोग इस मानवीय गतिविधि में शामिल हो सकें।
